Terms and Conditions for Auto Meal Chef

Welcome to Auto Meal Chef! These Terms and Conditions ("Terms") govern your use of our website, services, and applications (collectively, the "Service"), provided by automchef.com ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

• Account Creation: To use most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Responsibility: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
• Households: The Service allows you to create or join a "Household" to share information like pantry lists and meal plans with other users. The creator of the Household is responsible for managing its members. You are responsible for the content you share within your Household.

2. Subscriptions and Payments

• Free and Premium Services: The Service may include both free and paid subscription plans ("Premium"). Features available in each plan are described within the Service.
• Billing: We use a third-party payment processor (Stripe) to bill you for our Premium services. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms. We are not responsible for any error by the payment processor.
• Subscription: Our Premium plan is a recurring subscription (e.g., monthly or annually) that grants the entire Household access to premium features for the duration of the subscription term. Your subscription will automatically renew at the end of each billing cycle unless you cancel.
• Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period, and you will not be charged for the next period. You will retain access to Premium features until your current subscription period ends.
• Refunds: Subscription payments are non-refundable. No refunds or credits will be provided for partial subscription periods, except where required by law.

3. User Content

• Your Content: Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material ("User Content"). This includes pantry items, grocery lists, favorite recipes, and meal plans. You are responsible for the User Content that you post to the Service.
• License to Us: By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. This license is for the sole purpose of operating, developing, providing, and improving the Service. You retain any and all of your rights to any User Content you submit.

4. Use of AI Services

Our Service utilizes artificial intelligence (AI) to provide features such as recipe suggestions, pantry item identification from images, and receipt scanning. You acknowledge and agree that:

• AI-generated content is probabilistic and may not always be accurate, complete, or suitable for your needs.
• You are responsible for verifying the accuracy of any AI-generated content, including ingredients, dietary information, and cooking instructions, before use.
• We are not liable for any errors, omissions, or damages arising from your reliance on AI-generated content.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
• Uploading invalid data, viruses, worms, or other software agents through the Service.
• Impersonating another person or otherwise misrepresenting your affiliation with a person or entity.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Matthew Baumann and licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation of the Service or the information, content, or materials included therein.

In no event shall Auto Meal Chef, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Iowa, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
